Case UAPA against Newsclick: Court gives Delhi police an additional 10 days to finish their investigation

 

In the case filed under the provisions of the Unlawful Activities (Prevention) Act, 1967, the Patiala House Court of Delhi on Wednesday gave Delhi Police an additional 10 days to finish their investigation against Prabir Purkayastha, the founder and Editor-in-Chief, and Amit Chakravarty, the HR Head of News Portal.

following allegations that News Portal NewsClick received a sizeable payment to disseminate pro-Chinese propaganda. Hardeep Kaur, the Additional Sessions Judge, gave Delhi Police ten more days to file a chargesheet in the case and prolonged the accused’s judicial custody.

 

At the Delhi Police’s request, the court had already twice extended the investigation period. Prior to this, Delhi Police had declared that it had acted quickly to begin the investigation and that Special Public Prosecutor Advocate Akhand Pratap Singh was examining a substantial amount of data that had been retrieved. There are approximately 4 lakh emails and over 100 digital documents, and one of the accused does not live in India. Delhi Police continued, “We are currently gathering and summarizing evidence.”

 

Purkayastha and Amit Chakraborty, the HR head of Newsclick, were taken into custody by the Delhi Police in October of last year in accordance with UAPA. Right now, both accused are being held by the court. Recently, the case’s approver was changed to Amit Chakravarty by the court.

Examining and treating the approver—an accomplice who chooses to testify against the co-accused in return for a pardon—is a requirement of the CrPC. There are safeguards against forced or dishonest confessions, and the law requires that the approver’s testimony be backed up by supporting documentation.

Following his approval in the case, Amit Chakravarty has also filed a bail motion in the Delhi High Court. His request for bail has not yet been granted by the Delhi High Court. In their First Information Report (FIR) against Purkayastha, the Delhi Police’s Special Cell claimed that the People’s Dispatch Portal, run by PPK Newsclick Studio Pvt. Ltd., was being used to deliberately spread false information through sponsored news stories in lieu of millions of illegally transferred foreign currency as part of a plot.

The FIR went on to claim that foreign funds amounting to crores had been illegally infiltrated into India by hostile Indian and foreign entities as part of a plot to undermine India’s sovereignty and territorial integrity, sow discord against the country, and jeopardize its unity, integrity, and security.
