Following Elvish Yadav’s arrest, the Noida Police have likewise stepped up their investigation.
Elvish Yadav and five other people were arrested on November 3rd, 2018, at the Sector 49 police station under the Wildlife Protection Act (WPA) and Section 120 B (criminal conspiracy) of the Indian Penal Code for allegedly providing snake venom to partygoers in Noida for their purported recreational use.
At the time of the arrests, five suspects were found in possession of a 20-ml tube containing snake venom, along with nine snakes—five cobras, one python, two sand snakes, and one rat snake—that were protected under Schedule 1 of the Wildlife Protection Act, 1972.
In relation to the case, Elvish Yadav, a resident of Gurugram’s Wazirabad village, was detained by the Noida police on Sunday and subsequently placed under 14 days of judicial custody.
In response to a forensic report indicating that a 20-ml liquid found on the five detained suspects was krait venom, the police also filed additional charges under the Narcotic Drugs and Psychotropic Substances Act to the initial formal complaint.
The legal team for Elvish Yadav asserts that the arrest was “illegal.”
Elvish Yadav’s legal team, however, has claimed that the YouTuber was called to join the investigation as a witness but was later “illegally detained” and then arrested.
“Since the case was registered in November, Yadav has come for questioning five times after being summoned under Section 160 of the CrPC. On Sunday, too, Yadav was called for questioning but was illegally detained by the police and wrongfully shown as arrested. Yadav was not even informed as to why or for what offence he was being arrested, which in itself is illegal,” Elvish Yadav’s lawyer, Prashant Rathi, said.
Rathi added that Yadav had not been found in possession of any such contraband, such as snake venom, and that the offense for which the FIR was filed related to WPA.
“It is well known that Yadav was not even present at the aforementioned party and that no WPA contraband was found on him. Furthermore, only a government officer is permitted to take notice of an offense under this Act and file a complaint, in accordance with Section 55 of the WPA. However, in this instance, a complaint was filed by an NGO member, which is against WPA,” Rathi stated.
